App terms of use

These terms govern access to and use of the 4Link app, available at app.4link.app, which can also be installed on your phone as an app. Use of the 4link.app website is governed by the Legal notice.

1. Owner of the app

The app is owned by 4LINK EASY MANAGEMENT, S.L.U. (hereinafter, “4Link”), with Tax ID (NIF) B55653497 and registered office at Urb. Infinitum, Edificio Garbi I, Avda. Pla del Maset, 6, bajos 3º, 43840 Salou (Tarragona). Its remaining details are set out in the Legal notice.

2. Acceptance

Accessing the app implies acceptance of these terms. If you access it as a user of a client company, these terms are supplemented by the contract between your company and 4Link; in the event of any conflict, that contract prevails.

3. Licence of use

4Link, as the owner of all rights in the app, grants only the right to use it for the purposes for which it has been designed and in accordance with these terms. Use of the app does not confer any ownership rights over it.

4. Access to the app

To access the app, users identify themselves with their username and password or with the sign-in method available on their device. Each user has access to the features that correspond to their profile and can edit their profile details.

From the app, users can view and complete the tasks assigned to them, attach photos, videos and audio recordings as evidence when requested, ask for clarification about tasks and view the ratings they have received.

Users are solely responsible for keeping their access credentials safe. 4Link accepts no liability for any misuse of those credentials or for the consequences of their loss, of their being forgotten or of their use by unauthorised third parties.

5. Proper use of the app

Users undertake to use the app, its content and its services in accordance with the law, these terms, good faith and public order. In particular, they undertake:

• Not to use it for unlawful purposes or in any way that could damage it, make it inaccessible, impair it or prevent its normal use by other users.
• Not to destroy, alter, disable or damage the data or documents held in the app.
• Not to alter or modify any part of the app, nor to circumvent, disable or tamper with its security features, nor to use it in any way that alters, damages or disables 4Link’s networks, servers, equipment or software.
• Not to reproduce, copy or distribute the content of the app, whether for private use or to make it available to third parties.

6. Intellectual and industrial property

The content of the app (text, photographs, graphics, images, icons, technology, software, graphic design and source code) is the property of 4Link. No exploitation rights over it shall be deemed to be granted to the user beyond what is strictly necessary for the proper use of the app.

The trademarks, trade names and distinctive signs that appear in the app are the property of 4Link, and their use does not confer any rights over them on the user.

7. Operation of the service and liability

4Link provides the service on an ongoing basis, using all the technical means at its disposal, and may make corrections, improvements or modifications to the app whenever it sees fit, without this giving rise to any right to claim.

To the extent permitted by law, 4Link accepts no liability for the availability, reliability and technical continuity of the app, although it will endeavour to restore any interruption as soon as possible and, as far as it is able, to offer alternative means.

4Link has implemented the technical and organisational measures necessary to protect data and prevent its alteration, loss or unauthorised access, and accepts no liability for the disclosure of data to third parties that is not due to causes directly attributable to 4Link.

8. Backups

4Link makes backups of the content hosted on its servers. Nevertheless, it accepts no liability for the accidental loss or deletion of data by users, nor does it guarantee its full restoration, as that data may have changed since the last backup. Unless the contract with the client includes a specific backup service, the service does not include restoring content where the loss is attributable to the user.

9. Data protection

The processing of personal data in the app is explained in the Privacy policy.

10. Changes to the terms

These terms may be amended, so we recommend that you review them periodically. The date of the last update is shown at the top of this page.

11. Governing law and jurisdiction

These terms are governed by Spanish law. Any dispute concerning their interpretation or application shall be submitted to the courts and tribunals of Tarragona, unless the applicable legislation mandatorily establishes a different jurisdiction.
